Gabriella A. Wilkins is an associate with the firm. She focuses her practice on complex commercial and intellectual property litigation. She has represented a large range of clients as both plaintiffs and defendants throughout all stages of litigation, including drafting and arguing pleadings and dispositive motions, drafting and responding to complex discovery, conducting and defending depositions and handling trial preparation, mediations, and arbitrations. Ms. Wilkins is a highly experienced associate who has represented manufacturers, product companies, and other technology companies in copyright, trademark, and anti-counterfeiting litigation and other related matters, including domain name disputes and the filing of ICANN complaints. She also has represented Fortune 500 Companies in asserting complex indemnification claims against co-defendants and insurance carriers. Recently, Ms. Wilkins argued a Motion for Summary Judgment in the U.S. Central District of California for a breach of contract/founder’s dispute case, and also drafted key briefs and pleadings, and appeared on behalf of a major networking company in a trademark action in the U.S. Northern District of California.

Prior to joining the firm, Ms. Wilkins successfully represented medium to large companies in disputes involving breach of contract, land disputes, unfair business practices, insurance bad faith and construction defect. During law school, she externed for both the Fourth District California Court of Appeals and the U.S. District Court for the Southern District of California.

Representative Cases

Ms. Wilkins was part of the Bartko team that defended a claim for breach of alleged oral inheritance promises. Petitioner claimed she was promised a golf course in Spain and to be treated the same as Mr. Naify’s biological daughters in his final trust — claims valued between $250 million and $300 million. The three-week court trial resulted in a total victory for the trustees where the Court found petitioner failed to prove her alleged promises. Judgment has been entered in favor of the Naify Trust, including an award for legal costs. (In Re Trust of Robert Naify.)

Ms. Wilkins was the lead associate on a team representing two large technology companies in an international anti-counterfeiting action in the Northern District of California in which the Court issued two temporary restraining orders and ultimately a preliminary injunction against two Chinese defendants.
